I had a insurance claim that paid off my primary mortgage 103k. Leaving me a balance of 69k on my chase eguity loan. I sent them a check three weeks ago for 59k they are refusing to apply it to the principal until I come up with another 10k to pay the loan off. This seems to be illegal and I am going to call a attorney.

I received a insurance settlement paid off my primary no problem. Chase has my equity loan balance is 69k the insurance check I sent them three weeks ago is for 59,900. They are refusing to apply the funds to my principal until I come up with the 10,000 difference. This seems to be illegal.

My Husband and I are about to send them a check for them to sign over. I hope that I do not have any problems with them. I have had previous problems in the past with other issues. Please keep me updated on your situation.

I'm going through a similar experience. My husband and I are contemplating filing a class action lawsuit. He's a civil, defense attorney, and I've been in the insurance industry for the last 15 yrs.
They have been holding a check from our insurance company for the last 3wks, with no real explanation as to why they haven't released the funds to do repairs on our home.
We suspect that they hold the funds back to accumulate the interest, and if they do this to everyone, they are making a SIGNIFICANT profit.
At the very least, Chase's "procedures/policies" are highly suspect, if not unethical, and possibly illegal.
If anyone has experienced a similar situation, please e-mail me.
Specifically, I am looking for people who have filed insurance claims for damages done to their home, and then experienced a difficult time getting Chase to endorse the insurance check and release the funds.
