Property Bought: time-sharing property at Mystic Dunes Resort & Golf Club, Orlando, Florida (Contract ID 20303400-MD)on 25th September 2008.

Payment Mode:

(a) 10% of purchase price upon confirmation - paid by Credit Card on 25th September 2008.

(b) 40% of purchase price to be paid within 60 days from 25th September 2008 to enjoy interest free (0%) on balance 50% of purchase price over 12 equal installations. This 40% was received by Tempus Financial Services on 21st November 2008 (before the end of 60 days term).

(c) 50% of purchase price to be paid over 12 monthly interest free installation with effective from 25th December 2008 and to be ended on or before 25th November 2009.

Authorization for Automatic Debits Form was duly completed and faxed to Tempus Financial Services on 19th December 2008 via Fax Number: (407)226-9505 (with fax log receipt - acknowledge of receipt) for 12 monthly interest free installments to be charged to the same Citibank Credit Card which was used for the 10% downpayment on 25th September 2008.

On 09th January, 2009, Tempus Financial Services charged 1st month interest free installment which was due on 25th Dec 2008 and charged late fee of 10% on 50% of purchase price. The authorization on the payment was given on 19th December 2008, therefore as a customer, I never made late payment, why was I being charged for the late fee? Written a Protest/Complaint Letter on 09th January 2009, fax to the same number: (407)226-9505. But no one from Tempus Financial Services bother to call and/or reply to our request on the reversion of late fee and late payment.

On 09th February 2009, Tempus Financial Services charged 2nd installment(due on 25th January 2009) to the same Citibank Credit Bank and again charged late fee of 10% on 50% of purchase price.

After protested telephone calls and emails - no repayment of late fees was made, but instead on 25th February, 2009, 38.55% of the 3rd Installment (due on 25th February 2009) was charged to the same card - who authorized for this payment? in my Authorization for Automatic Debits Form dated 19th December 2008, it should be 12 (twelve) equally interest free installment from 25th December 2008 to 25th November 2009, no authorization on partial payment. Due to this partial payment with our authorization, late fee of 10% on the 50% balance of purchase price was charged on 10th March 2009.

Due to the partial charge (38.55%) of installment, we thought that the charge could have been a credit card fraud and subsequently replaced a new Credit Card ending with 1131. 61.45% plus the late fee were charged to the new card on 10th March 2009.

Authorization for Automatic Debits Form on the new Credit Card (ending with 1131) was faxed (407)226-9505) and email to Tempus Financial Services on 02nd March 2009.

4th Installment due on 25th March 2009, and till todate of complaint, we noticed Tempus Financial Services has not charged the 4th Installment to the Credit Card (same card being charged on 10th March 2009 for the 61.45% + Late Fee). This is leading to an obvious assumption that Tempus Financial Services is purposely delaying the auto debit of monthly installment, so as they can charge 10% late fee (10% per month on 50% of purchase price is equivalent to 120% of 50% of the purchase price - paying 120% of interest per annum - this is worst than loan shark).

Not to forget, I did lodge the same complaint/request as above via Tempus Financial Services website, Member Login Service (via Contact Us) in February 2009 or March 2009, but till today there is no reply at all in whatsoever. Unfortunately, feedback(s) through the Contract Us within the member login website, there is no record to trace.

I sincerely wish and hope that USA Authority can assist me on this matter, otherwise, I will end up as the victim to pay 120% interest per annum.
