I opened a checking account online with Bank of America (BoA) last year. The promotion was that monthly fees were waived for opening your account online. Back in June of this year I stopped using the account for financial reasons, not problems with BoA at that time.

OK, so I end up being offline, no internet, for several months. During this time BoA decided to start imposing a monthly fee to my account. Thanks to these fees my account became overdrawn because I used my card, unaware of the fees being taken out of my account.

Well, since I stopped using the account and to my knowledge the balance was a positive one with no monthly fees to worry about I had not tried to check on it in quite sometime, I left it open because I intended to use it again.

I recently get a card in the mail stating my account was in the negative almost $100 since my last use of the bank card. I got online to look at the account and sure enough there had been 4 monthly fees added to the account along with 2 overdraft charges of $35 each for 1 item that caused the account to overdraw due to the monthly fees being added in.

I sent an email to the customer service department to question the charges and overdraft fees.

BoA responded that the fees were legitimate and that the only way the avoid monthly fees is with a direct deposit.

I responded that when opened my account monthly fees were waived because I opened it online.

Customer service rep number 2 admits the fees were supposed to be waived but will only refund the 2 most recent monthly charges.

I politely respond a 3rd time and request that the first two charges, the ones that caused the overdraft, along with the overdraft fees be refunded as well.

I am then instructed to call customer service to correct this. I call and after talking to a customer service rep and their supervisor am told by both that yes the charges were an error of BoA but that I have to pay them anyways because they are too old to be refunded.

I tried to explain that I had no internet access during that time and had just recently received the card in the regular mail showing any problem with my account. They basically told me tough luck I am responsible for BoA's errors.
