Customer injury in store- Target never paid any medical bills

On 4/27/06, I was getting a soda in the snack bar at the Target store in Brandon, Florida and was hit on the head by the top of the soda machine. It just fell off as my soda was filling in my cup. I was stunned, my speech was slurring and I was visably shaken. No one from target even asked if I was ok when multiple employees saw it happen from behind the food service counter. They took the piece that fell and shoved it behind the counter. I sat at the table with my two children who were with me and saw it all happen and decided I needed to go get some medical attention. As I was getting up from the table, two men approached me and asked me if there was a problem...well I told them there sure was. Explained what happened and they shoved an accident report under my nose to sign. I asked them if I needed medical care, what do I do as I was feeling funny and my head was hurting and they said just call the number on the back of the sheet. They even had the nerve to ask me if I had any more shopping to do- duh- no of course not- I actually didn't even get to shop since I hit my head and could hardly walk cuz I was in pain... To make this story short, I eventually ended up getting my folks to drive me to the hospital and spent 12 hours being examined. I have permanent damage to my back and neck and suffer every day because of it. Target has not paid a cent on my medical expenses- they never respond to emails, I have had to fax them authorization to release my medical records, not once or twice, but three times. They have never once apologized to me for this happening even though its their negligence that this happened. My husband works close by and went in the store a few weeks after this happened and he joked with the man behind the counter- this isn't going to fall on me is it (referring to the soda machine as he got a soda) and the man said- yeah- they finally fixed it-I was telling them someone was going to get hurt. My husband proceeded to tell the guy it was his wife that got hurt. The guy was really embarrassed and stopped talking after that. SO-my advice to anyone out there is to not shop at Target-if you do and you get hurt by their negligence, they will never take care of their responsibilities....I really hope someone from Target reads these messages- there is a lot of competition out there when it comes to department stores- and I have found somewhere else to go-I hope others who have been wronged by them will do the same and frequent another place other than Target.

To the person that the soda machine fell on. why did you not go after the soda machine company? doesnt target rent that equipment from an outside company?

I just got injuried at target they had there vacum cleaners on shelf about 3 feet above head level I was moving the vacum to get better look when the unsercured and poorly put togethere vacum came apart and fell on my head the canister hit me with some good force causing me to fall back, a manager had me fill out a incident report and said someone would call me within the next few days. I left the store and about 30mins later I was in the emergercy room ,I was sick,turned out i suffered a concucions, that was 2 weeks ago and I m still having sever headache my family dr,is concerned and wants to do another catscan Target contacted me and I told them that i have medical bills becuase the hospital billed me directly instead of my insureance because they siad it was there negilgence, the women I talked to from target said that it will be 30 days for them to investagate and detirm whos fault,again like the woman who got hit on the head by the soda machine this was clearly there fault. Now after reading all these stories Iam worred that they will not pay the medical bills

How can Target get away with this. I am sending out an SOS. I am currently in San Diego Federal Court, without an attorney because as my last attorney said from a business stand point and the money we (Atty) will pay upfront is not worth it. My accident happened on August 30,2007 and I was post status a L4-5 fusion. There was a 25 foot trail of water which I slipped and fell landing hard enough to herniate another disc. Other customers and Target employees came over and since I was unable to move had to be helped up, at which time I informed the employee I wanted to have an incident report filed- luckily in addition to my 2 sons there were allot of other witnesses, 2 of which gave them names,address and phone number-they have since given a statement to what happened, along with a letter from my orthepedic surgeon, because of the fall I had to have a L3-4 fusion. Medical expenses alone are 106,000 and at our 1st ENE Conf., Target's defense was and is our video does not show the plaintiff in our store,therefore the accident did not happen. They state they have video of me leaving the store in their ECV (to my car),however before we left I was feeling really sick and Target employee called the ambulance. Their Team leader states trail of water caused fall but I was told another employee said when she asked me to fill out an incident report I declined. That is so not true, she is lying. Also, no warning cones around the water and it is my understanding Target does not have any training of employees on guests and accidents. Can anyone confirm or deny whether they keep sweep sheets and is there anyone out there that may have also seen this accident. Also, the Team Leader had the security guard take a photo of the water trail and I left a shoe skid mark as I went down and the Target defense to that is it is a photo of a cart wheel, even though the guard was told specifically to take a photo of the shoe mark. Please can anyone give me any advise since I cannot find an attorney to handle this case in Federal court. Please email me at mapolakm@cox.net Thank you

The same thing happened to me in October 2004. I had to have surgery and incurred almost $100,000 worth of medicals, but they never offered me anything for my injuries. A customer witness my fall and the manager heard it. There was lotion on the floor. Target agrees that I fell, but they are not liable.

Part of the problem here is the government allowing Fly By Night Insurance companies like Target's Sedgwick to run around loose. The sad thing here is the consumer doesn't even get to choose their company here. They're at the mercy of whomever big corporations like Target choose. All we need to do is Google in "Complaints against Sedgwick" and we'll know right away they're a substandard company. Why does Minnesota allow this? And, why do so many companies with Corporate offices in Minnesota get comsumer complaints?

I contacted a few local attornies but they seemed to think I needed to wait until my treatment was further along. I am rouding three years since the accident and my injuries are still the same. The therapy gets me from appt. to appt. but it will probably never go away. I will keep you posted as to my progress- I wish you luck in yours. Sounds like Target needs to accept responsibility for these things. My situation was totally NOT my fault- I was just tapping a soda and their reps said that they would never accept responsibility for the incident. Can't imagine why not- but we will see once the case goes further.

Who's making these reviews? The Board of Directors at Target? If we get taken advantage of by big corporations are we just supposed to smile and take it?

The government isn't going to help. Obama has already backed down on his promise to tax the big guys. Corporate America will not stop taking advantage of people until we band together and fight back. Especially against arrogant, smug corporations like Target.

Thanks for the comment- actually, I have heard back from Target after running around and going through hoops to obtain all my personal medical records and bills-they offered me $750.00 for my medical expenses. What a joke- that won't cover four therapy visits-and I have had somewhere around 75 visits already-and the claims adjuster who was helping me said he didn't agree with the offer-he said he was told to offer me that and a Target gift card. That tells you what Target thinks about their customers- he told me they would never admit their at fault-the rep from Target told the claims adjuster that the piece did not weigh enough to hurt me and that this was their final determination. He said Target would hire a physics expert and have them testify that there is no way the piece could fall the way it did and hit me and cause an injury and that I would not get a thing. I have since contracted an attorney and I will now take whatever action I need to resolve this issue and get reimbursed for my medical bills and something to take care of my future medical expenses. Target should learn from their mistakes and do the right thing by their customers-especially when they WERE AT FAULT. I was legitimately injured in their store by THEIR negligence-for pete's sake I was only getting a soda and did nothing wrong and they made me feel terrible with their ridiculous offer to settle this issue for $750.00. Their claims representatives from Sedgwick management took as much time as they could to delay this- they lost my hospital bill and repeatedly claimed they were never sent my medical records. I finally sent them certified so I got the receipt. I was hoping not to get an attorney involved- hoping that they would do the right thing by me and pay me to take care of the bills and my future care. They chose not to and now will have to fight out in court. I am hoping if there was anyone there the day it happened-they will come forward and testify against Target. It will help justice prevail and the person who was wronged will be compensated for their injuries and for future care. As I get older, I am sure this injury will get worse. I cannot even pick up groceries or let my two kids come up behind me and hug me-it hurts. No one should go through this and its Target's fault - not mine. Thanks again for the support and I wish you luck with your issue with them.

I am amazed that you didn't hire an attorney to resolve this. You should have received some form of compensation for your injury, and Target should have to pay your doctor bills until your injury is resolved.....or at the very least, up to a certain point agreed to by both sides before an arbitrator. I am not an attorney. I was severely injured by Target's negligence. I have cancer and diabetes and I've also been on steroids for 7 years so my skin is very thin and tears like paper. Any wound I get takes forever to heal and there is also the danger of infection and I was diagnosed with sepsis and hospitalized many times since my injury. The accident happened in late December 2007 and as of today, August 28, 2008, my leg wound is still not healed. Target attorneys are ignoring my emails with pictures so I will seek an attorney for representation. If anyone wants to join the lawsuit, perhaps we can get them to change
