XPOSE Photography Complaint

Bait and switch Scam!

XPOSE Photography (http://xposellc.com/) is a scam! Watch out! (Check out their complaints with the Better Business Beuro.)

I responded to an add on www.ksl.com under the FREE classifieds section. The add stated that the first two callers would receive 2 hours of free wedding photography and said to ask for Michelle. I called and left a message because Michelle was not in.
Michelle called me back on the 31st of December 2008 and explained that I won the mentioned 2 free hours of wedding photography but that she needed to take a $100.00 deposit right then in order to reserve a photographer for the date of the wedding. Michelle explained that I could use the deposit money to purchase additional photography time or prints later on. I told Michelle that my fiance was planning the photography and that I needed to speak with her but didn't want to loose the wedding date. I asked if I could "receive a refund if we decided NOT TO PURCHASE ANYTHING AT ALL". She said yes and I gave her my Visa credit card information. Michelle then asked me to setup an appointment to come in with my fiance to discuss all the details. We set an appointment for 4:30pm on January 14th 2009.
At the appointment we learned that Michelle had scheduled our wedding photography for the 31st of January 2009 INSTEAD OF the 21st of January 2009. Michelle scribbled out the incorrect date and made the appropriate correction. Michelle then explained to my fiance and I that the promised 2 hours of photography was actually only 1.5 hours. She also explained the prices to purchase prints or a cd ($299.00 for un-edited pictures!). My fiance and I discussed the prices and our budget and determined that XPOSE was WELL beyond our means and told this to Michelle and asked to forfeit our "2 free hours of photography" and just receive the promised refund of our deposit money ($100.00). Michelle left the room and returned with her manager who then spoke with us in a rude manner (but with an obnoxious smile) and said "I'm not giving your money back. I don't care what you say. I don't want to argue. Your not getting your money back. The economy is tough for us all." XPOSE refused to refund my $100.00 deposit. My fiance responded "Then we will be taking this up with the Better Business Beuro", to which the manager reply was "Go right ahead. Your not getting your money back." and we left. We DID NOT sign or agree to anything. We were NOT informed that a refund would not be possible in fact I asked specifically about it BEFORE I gave my credit card info out over the phone.
Please note that to date XPOSE has over 60 days in advance notice to un-schedule the photographer, which they scheduled on an incorrect date, which was after the wedding date anyway.

False Advertising, Bait and Switch, and Intentional Misrepresentation are how I would describe XPOSE Photography if someone were to ask me. To be honest I am less concerned with my money than I am about other future newly weds being scammed like we were.

In reviewing my comment above (about the month of my wedding typo), I just realized that it might not be clear that when I said the Month of my wedding is actually March and not January I also meant that XPOSE had recorded the month of March for my wedding date too and not January. (Not that it makes much difference whether they had my wedding date written down 60 days off, 10 days off, or even 1 day off. If it was off it was off.)

In this incident I said, by mistake, that my wedding date is the 21st of January 2009. I meant to say the 21st of March 2009. (I was thinking about the current month, in which we met with XPOSE.) March 21st 2009 is our wedding date.
